Ponchi ("Ponchi," "we," "us") is operated by Optima BuildSolutions LLC (a brand of Zet8 Tech), located at Cypress, TX 77433, United States. This policy explains what data the Ponchi mobile app and web service collect, how we use it, and the choices you have. Ponchi is a workforce-management tool for businesses; most users are employees and managers of a business that subscribes to Ponchi.

Who controls your data

When a business signs up for Ponchi, that business is the controller of its employees' data and uses Ponchi to manage time, attendance, and scheduling. We process that data on the business's behalf as a service provider, and also as needed to operate and improve Ponchi.

Data we collect

• Account and identity information: name and email address (and phone number, if provided) for account holders, managers, and employees, used to create and manage accounts and to send service communications.
• Location information: when an employee clocks in or out, the app collects precise device location at that moment to verify the clock event against the assigned work location (geofencing). Location is collected only at the time of a clock event when this feature is enabled by the business — Ponchi does not track location continuously in the background.
• Photos: when enabled by the business, the app captures a photo (selfie) at clock-in and/or clock-out to verify attendance. These photos are used for attendance verification only and are not used for facial recognition or biometric identification.
• Work records: shift schedules, clock-in/out times, hours worked, and manager approvals.
• Technical and diagnostic information: app version, device type, and crash/diagnostic logs to keep the service reliable and secure.

How we use data

To provide and operate Ponchi (clock-in/out, scheduling, approvals, payroll exports); to authenticate users and secure accounts; to communicate about your account and trial; to provide support; to maintain, protect, and improve the service; and to comply with law.

Payments

Subscriptions are purchased and managed on our website at app.ponchi.app and processed by our payment processor, Stripe. Payment card details are handled by Stripe and are not collected or stored by the Ponchi mobile app.

How we share data

We do not sell personal data. We share data only with service providers that help us run Ponchi (for example, cloud hosting, email delivery, and payment processing), bound to handle data on our behalf; with the business that controls the relevant account; and when required by law or to protect rights and safety.

Data retention and deletion

We retain personal data for as long as the account is active and as needed to provide the service. You may request deletion of your account and associated personal data at any time — in the app (More → My Account → Delete My Account) or via the web at https://api.ponchi.app/delete-account. When we delete an account at a user's request, we delete the associated personal data, except where we must retain certain records for legitimate purposes such as security, fraud prevention, dispute resolution, payroll/wage records, or legal compliance.

Security

We use industry-standard safeguards, including encryption of data in transit, to protect personal data. No method of transmission or storage is completely secure, but we work to protect your information.

Children

Ponchi is a workplace tool intended for use by businesses and their workers. It is not directed to children and we do not knowingly collect data from children under the age required by applicable law.

Your rights

Depending on where you live, you may have rights to access, correct, delete, or restrict the use of your personal data. To exercise these rights, contact us at hello@ponchi.app.

Changes

We may update this policy and will post the revised version with a new effective date.
